The short version

Douga is free to use. Every feature works without a license key. Exports from an unlicensed copy carry a small Douga mark, and that's the only difference.

Everything you make with Douga is yours. All of it, always, no matter which version you use. Douga claims no rights over your work and asks for no credit.

A license key removes the export mark. A personal key covers an individual's own work, paid commissions and freelance included; the commercial key is for studios and companies.

Your key has your name and email signed into it. Keep it to yourself.

Douga is in beta and is provided as-is, with no warranty. Save often and keep backups of work you care about.

Who this is between

This agreement is between you and Kei Hoag, the developer of Douga ("the developer"). By installing or using Douga you accept these terms. If you don't accept them, don't use the software.

The software

Douga is a 2D animation application for Windows. You may download it from the official page and use it free of charge, for any purpose, personal or commercial, for as long as you like. Every feature is enabled in the free version.

Frames exported from an unlicensed copy carry a small Douga mark. The mark identifies the software, not you, and does not limit what you may do with your exports.

Your work is yours

Everything you create with Douga - every drawing, frame, and animation - belongs entirely to you. The developer claims no ownership of it, no license to it, and no credit for it. You may use, publish, and sell your work freely, whether or not you own a license key.

License keys

A license key is issued to one person, with that person's name and email signed into it. You may use your key on any number of computers that are yours. A key may not be shared, published, resold, or transferred to someone else.

There are two kinds of key:

Personal. For an individual buying with their own money and working on their own behalf. Removes the export mark from everything you make as that individual - hobby projects, studies, portfolio pieces, commissions, freelance work, and work you sell.

Commercial. For organizations. If a studio, company, or other organization pays for the seat, or the copy is used for an organization's own productions, this is the license it needs. It removes the export mark for all work in any context. An organization that would rather not buy seats can still use the free version - the mark is the only difference.

Keys are verified inside the app, offline. There is no activation server and no phone-home.

What you may not do

You may not:

a. share or publish a license key, or use a key issued to someone else;

b. remove, disable, or bypass the export mark or the license check, or distribute copies of Douga modified to do so;

c. create, forge, or sell license keys;

d. redistribute Douga itself as your own or bundle it with other products without permission - link people to the official page instead, so they always get the current build.

Beta software

Douga is in beta. It is stable enough to ship but it will have bugs, and a bug in an animation program can cost you work. Save often, and keep backups of anything you care about.

No warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SOFTWARE - INCLUDING LOST WORK, LOST DATA, LOST PROFITS, OR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES - EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE DEVELOPER'S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE, IF ANY.

Some jurisdictions do not allow certain warranty disclaimers or liability limits; where that is the case, the above apply to the fullest extent the law allows.

Privacy

Douga has no accounts, no telemetry, and no analytics, and the application itself opens no network connections. The optional update-check plugin, if you choose to install it, asks the download page for the latest version number and sends nothing about you or your machine. Purchases are handled by the store you bought from, under that store's own terms and privacy policy.

Refunds

Purchases are made through the store page (itch.io) and refunds are handled there, under the store's policies. If something is wrong, get in touch - see section 13.

Termination

Your license key's rights end if you materially breach this agreement (for example, by sharing your key or distributing a version with the mark bypassed). Sections 3, 7, 8, and 12 survive termination; your ownership of your own work is never affected.

The optional pose reference packs contain Eadweard Muybridge's motion studies from the 1880s, which are in the public domain. Video import and export use an ffmpeg installed and controlled by you; Douga does not include or distribute ffmpeg.

General

If any part of this agreement is found unenforceable, the rest remains in effect. This is the entire agreement about the software between you and the developer. New versions of Douga may ship with updated terms, which apply to those versions.
